APC asks Supreme Court to erase evidence tendered by PDP in Cross appeal

The All Progressives Congress (APC) in a cross-appeal has asked the Supreme Court to expunge some documents and evidence tendered by Atiku Abubakar and the Peoples Democratic Party (PDP) from the bar.

According to The Cable, the documents in question were provided by witnesses 40, 59 and 60 presented during proceedings at the court of appeal.

The APC consequently asked the Supreme Court to set aside the decision of the presidential election petitions tribunal which admitted the evidence and documents.

Meanwhile, APC’s counsel, Lateef Fagbemi, said the tribunal erred when it admitted the documents tendered by PDP, describing the act as a “miscarriage of justice and violation of the law”.

“The learned justices of the court of appeal erred in law when they failed to consider or properly consider the cross-appellant’s objection to the admissibility of the documents tendered by the petitioners/cross-respondents’ counsel from the bar,” he said.

“Inadmissible documents/evidence cannot be admitted based on the overall interest of justice but of law.”

Recall it was reported that Atiku Abubakar, and his party, formally filed their appeal against the judgement of the presidential election petitions tribunal at the Supreme Court.

Atiku said the tribunal erred in its verdict on Atiku and PDP’s petition against the election of President Muhammadu Buhari.
