Supreme Court Reschedules Hearing In Uche Secondus’ case Against PDP Over sack

The Supreme Court in Abuja on Monday suspended its planned hearing of the case brought by the sacked National Chairman of the People Democratic Party (PDP) Prince Uche Secondus, challenging his removal from office.

A five-man panel of the apex court, led by Justice Musa Dattijo Mohammed, took the decision upon realising that a respondent in the case, the South-South Zonal Chairman of PDP, Dan Orbih was neither in court nor was he represented by a lawyer.

At the mention of the case on Monday, the court noted that while other parties were represented, no lawyer announced an appearance for Orbih.

Upon enquiry, it was found that Godwin Obla (SAN), who earlier represented him, wrote to the court that Orbhi was yet to properly brief him to handle the case on his behalf.

Appellant’s lawyer, Oba Maduabuchi (SAN), who was uncomfortable with the development, claimed that his client did not originally sue Orbhi but that he allegedly included himself in the case on the excuse that he is a zonal chairman of PDP.

Instead the court adjourned till December 7 for the hearing of all pending applications.

Secondus is, by the appeal marked: SC/CV/1048/2021 seeking among others, the nullification of his removal from office, on the grounds that the PDP acted unlawfully by removing him based on his purported suspension by his ward.

Respondents in the appeal are Ibeawuchi Ernest Alex, Dennis Nna Amadi, Emmanuel Stephen, Umezurike Onuoha, Godwin Pepple Manfred, PDP, Senator Suleiman Nazif, Orbih, Hon Solomon Ejike Ogbonna, Hon Uche Emmanuel Minukwa and Senator Samuel Nnaemeka Anyawu.

Recall that the Court of Appeal sitting in Port Harcourt had on October 26 dismissed Secondus’ application challenging his suspension from the Peoples Democratic Party (PDP), a decision he appealed to the Supreme Court.
