Appeal Court In Owerri Dismisses YPP Suit Challenging Governor Uzodimma On Tenure Extension Of Imo Auditor – Gen For LGAs



The Court of Appeal Sitting In Owerri, Imo State has struck out a suit instituted by the Young Progressive Party (YPP) challenging the legality of the grant of extension of service or tenure of the Auditor General for Local Governments, Imo State in the person of Barr. Osita R. Nwosu by the Governor of the State, Distinguished Senator Hope Uzodinma .

The defendants in the suit were: Governor Hope Uzodinma, the Attorney General and Commissioner for Justice, State Head of Service (HOS) the Speaker of the State House of Assembly and Auditor General For local Governments, Imo State.

Delivering his judgement which lasted for almost 30 minutes, the presiding judge – Hon Justice I W. Jawro (Hall 11) cited and relied on series of relevant sections of the Imo State Local Government Laws and other related laws, legal documents and stated that the Appellants lacked merit in their application which he said was ultra vires.

Justice Jawro further added that the Appellants (YPP) equally lacked the locus standi to sue the defendants, noting that the lower court had earlier dismissed the case for lack of merit.

Consequently, Hon. Justice Jawro dismissed the case for lack of merit with a cost of N200,000 to the Appellants.
