Businesswoman alleges illegal sale of disputed Lekki land

A businesswoman, Alhaja Safurat Olufunke Oladega, has raised the alarm following the alleged illegal sale of some portions of disputed land at Oke Segun Community in the Lekki Local Council Development Area (LCDA).
Oladega, who spoke in a statement by her lawyer, Lanre Balogun, said the land is the subject of litigation pending at the Epe High Court, Lagos
She identified the suit as ‘EPD/7795 LMW/2018’ between Toheeb Ilesanmi and another vs. Chief Muftau Dauda and another.
Oladega warned that unauthorised sale of any portion of the land would be a nullity. She urged the public to be wary of land speculators and advised potential buyers to keep off.
The statement reads: “This is to inform the general public that the land situate, lying and being at Oke Segun Community under the Lekki Local Council Development Area and delineated in survey Plan number LS/T/LA2273 and drawn by the office of Surveyor D. O. Olatunbosun and dated 11th August, 2009 is a subject of litigation pending before the Lagos State High Court Epe Judicial Division in suit No- EPD/7795 LMW/2018 between Toheeb Ilesanmi and another vs. Chief Muftau Dauda and another.
“Be further informed that any forms of sales, assignment or delineation of any portion of the land would be caught up by the doctrine of lis pendens (pending legal action) and the effect of any sale, assignment and delineation was well explained by the Supreme Court in the case of Osidele vs. Sokunbi.”
“Any seller stands the risk of lack of capacity to effect a legal transfer of the title while the buyer of the disputed land stands the risk of purchasing nothing from the vendor.”
It added that ‘’the sales of a property, the subject matter of litigation, during the currency of such litigation is by the doctrine of lis pendens void and where any conveyance and agreement is subsequently made pursuant to and in furtherance of such transaction after the end of the litigation, it would in the same vain be void.”
